Terms & Conditions
Effective as of
These terms and conditions apply to the PrintLapse app for mobile devices, together with any related services operated by Ihor B (collectively, the "Application"). Ihor B is hereby referred to as the "Service Provider".
By downloading or using the Application, you agree to these Terms and Conditions. Please read them carefully before using the Application.
What the Application does
PrintLapse records timelapse videos of 3D prints. It captures still images with your device camera, assembles them into a video, and saves the result to your device. The Application does not host, transmit, or publish your content, and the Service Provider operates no servers and no user accounts.
Licence to use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Application on a mobile device for personal or internal business purposes.
You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except to the extent that such activity is expressly permitted by applicable law.
Your content
Everything you record with the Application belongs to you. Photos, session data, and exported videos are stored on your device. The Service Provider does not receive, store, access, moderate, or acquire any rights in your content, and claims no licence over it.
When you use a share button, the Application passes the exported video to another application that you select. What happens to it after that is governed by that application's own terms, and is outside the Service Provider's control.
You are responsible for what you record. In particular, you are responsible for complying with any laws that apply to filming people, private property, or restricted locations in your jurisdiction.
Pro purchase
The Application is free to download and includes a paid one-time "Pro" unlock, which removes the export watermark and enables higher resolution and frame rate, full session history, and additional recording and effect features.
- Purchases are processed by Google Play, which acts as merchant of record. The Service Provider does not process payments and never receives your payment details.
- The Pro unlock is a one-time purchase, not a subscription. It is tied to the Google account used to buy it, and can be restored on another device with the same account using Restore purchases in the Application.
- Refunds are handled by Google Play under Google's refund policy, and any statutory right of withdrawal you have under consumer law applies in addition to it. Requests can also be sent to besgmo@gmail.com and will be forwarded or supported as far as the Service Provider is able.
- Prices are shown in the Application before purchase, in your local currency where Google Play supports it. The Service Provider may change prices for future purchases; a change never affects an unlock you have already bought.
If a Pro feature stops working because of a defect in the Application, contact besgmo@gmail.com. Nothing in these Terms limits your statutory rights in respect of digital content that is not as described.
Intellectual property
The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. Nothing in these Terms grants you any right to use the Service Provider's trademarks, logos, or branding.
You agree not to remove, alter, or obscure any proprietary notices displayed in or on the Application. The watermark applied to exports in the free version is such a notice: removing or obscuring it by any means other than purchasing the Pro unlock is not permitted.
Eligibility
By using the Application you confirm that you are legally permitted to do so in your jurisdiction. The Application is not intended for children under 13, or such higher age as applicable law requires. If you are under the age at which you can enter into a binding agreement where you live, a parent or legal guardian must review and accept these Terms on your behalf.
Availability, updates, and changes to the Application
The Service Provider may modify, update, or discontinue the Application at any time.
Operating system requirements may change, and you may need to install updates to continue using the Application. The Service Provider does not guarantee that the Application will always be compatible with every version of your device's operating system, and may cease supporting earlier versions of the Application.
Some functionality requires an internet connection — specifically, verifying and restoring your Pro purchase. Recording, editing, and exporting work offline. The Service Provider is not responsible for mobile data charges, including roaming charges, incurred through your use of the Application; if you are not the bill payer for the device, you confirm you have the bill payer's permission.
The Service Provider strongly advises against jailbreaking or rooting your device. Doing so may expose your device to malware, compromise its security features, and may cause the Application to malfunction.
It is your responsibility to keep your device charged, secure, and in working order. The Service Provider cannot be held responsible if you are unable to use the Application because your device runs out of battery, runs out of storage, or is otherwise unavailable.
Termination
The Service Provider may suspend your access to the Application if you materially breach these Terms. Written notice of the breach will be given and, where the breach can be cured, you will have 14 days from receipt of that notice to remedy it. If it is not cured within that period, access may be terminated.
Access may be suspended or terminated immediately and without notice if you violate applicable law, infringe intellectual property rights, or act in a way that could harm other users or the Service Provider.
Upon termination, your licence to use the Application ends and you must delete all copies from your devices. Content already stored on your device remains yours.
Limitation of liability
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
The Service Provider is in particular not liable for loss of recordings. Sessions and exported videos are stored only on your device. Keep your own backups of anything you cannot afford to lose.
The Service Provider retains full liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, the Service Provider's total liability for any claim shall not exceed the greater of (a) the amount you paid for the Application in the 12 months preceding the claim, and (b) the minimum amount that must be payable under applicable law.
Nothing in these Terms limits any rights you have under consumer protection law that cannot lawfully be excluded.
Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider and its affiliates, officers, employees, and agents against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising directly out of your breach of these Terms or your intentional misuse of the Application.
This does not apply to claims arising from the Service Provider's own negligence, breach of these Terms, or violation of applicable law. Where consumer indemnification is restricted by law, this clause applies only to the maximum extent permitted.
Third-party services
The Application uses the following third-party services, each governed by its own terms:
- RevenueCat — purchase verification and restoration — https://www.revenuecat.com/terms
- Google Play Billing — payment processing — https://play.google.com/intl/en/about/play-terms/
Privacy
Use of the Application is also governed by the Privacy Policy, which explains what data is processed and why. In summary: your recordings stay on your device, and the only personal data processed is what is needed to verify and restore your purchase.
Digital Services Act
The Application is not an intermediary service within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act). It does not host user content, does not transmit content on behalf of users, and provides no means for users to disseminate content to the public through the Service Provider. Accordingly, the DSA obligations applicable to hosting and online platform services do not apply.
If the Application later adds features that make it an intermediary service, these Terms will be updated before those features are released, and the corresponding notice-and-action, statement-of-reasons, and redress mechanisms will be published at that time.
Governing law and jurisdiction
These Terms are governed by the laws of Ukraine, excluding its conflict of law rules, except where mandatory consumer protection law in your country of residence provides otherwise.
Any dispute arising out of or relating to these Terms will be brought before the courts having jurisdiction under applicable law. If you are a consumer resident in the European Union, you retain the right to bring proceedings in the courts of your place of residence, and nothing in this clause deprives you of the protection of mandatory provisions of the law of that country.
Severability
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Application, and supersede any prior agreements or understandings.
Changes to these Terms
The Service Provider may update these Terms from time to time, and will publish the updated version on this page with a new effective date. Continued use of the Application after the update takes effect constitutes acceptance of the revised Terms. Where a change materially reduces your rights, reasonable advance notice will be given.
Previous versions are available on request at besgmo@gmail.com.
